Modified Federal Communications Commission FCC Changes For SMS Marketingadmin
On Oct Sixteenth 2013, the FCC made some requirement changes to sms marketing programs. Since then sms messages first became available as an option for promotion there have been certain policies in place. However, because of a variety of legal cases, people who have misused the guidelines, and due to an extremely large amount of SPAM complaints, the FCC has decided to tighten up the guidelines controlling the use of sms marketing messages.
Campaign Subscription / CONFIRMATION TEXT –
One of the biggest changes that will be seen within the text promotional industry is the use of a confirmation text. Previously as long as clients received a message informing them they had decided to obtain messages (at opt-in), as well as some other legal vocabulary, it was okay to start send them text messages. It will now be required for customers and clients to response ‘Yes’ to the notification text before to being included with your data source, unless they opt-in directly by text messaging your keyword to the short-code.
ADDING A CONTACT –
In the past there has been no time period limits on when contacts may be included to the data source, under the new requirements there is a 48 hour rule. This rule allows contacts to be included to a database ONLY within 48 hours from the duration of written consent. When adding a message personally the customer will still acquire a message to opt-in, and have to response ‘Yes’ before to being verified within the database.
IMPORTING CONTACTS –
Limitations on the publishing of contact figures are going to be extremely limited. Because of the 48 hour rule and verification written text, the importing of figures within messaging records will only be permitted if the data source recently been used with another sms marketing company and is just being shifted over to company’s short rule. Customers may be requested to provide certification of past company information.
Some customers have been puzzled in the past about getting explicit permission to use a number for sms marketing purposes. Just because a person decides to buy something from a company does NOT give the company permission to use that number for promotional and marketing purposes. A company may not require a person to share their phone number for text marketing purposes in order to buy. When a person opts-in from their cell-phone they will still get the standard written text with reports and will be added to the database.
